Description

In this edition, we have added forty-eight problems, spread across all chapters except Chapter 5 on presumptions. Several problems have been added in Chapter 10 examining the application of new Federal Rule 107 on illustrative aids. In Chapter 11, a number of new problems concern the authentication of websites, social media, and video, as well as the application of the best evidence rule to such media. New problems have been added in the hearsay and confrontation chapters to highlight the Supreme Court’s decisions in Smith v. Arizona and in Samia v. United States, as well as amendments to Rule 801(d)(2), and the declarations against interest exception. Among the new problems dealing with privilege in Chapter 15 are four involving the marital privileges and five involving the attorney-client privilege, focusing on issues that are often misunderstood by law students. Many of the new problems draw their inspiration from recent appellate opinions dealing with cutting-edge evidence issues.
