This critical race theory in property content is designed to stand alone and can be used to facilitate classroom discussions related to systemic racism and the law in your property class. It is drawn in large part from the property chapter of Brown’s Critical Race Theory, 4th.

The chapter begins with a brief introduction to critical race theory which looks at how societal racism shaped property legal principles. The chapter begins with an examination of the foundations of property law which has resulted in the law’s enforcement of racial violence including the doctrine of discovery and the very nature of property. It includes a selection of cases generally covered in most property subject matter casebooks as well as law review articles discussing the cases which provide additional information that allow for a fuller discussion of the role of racism in the case. After each set of readings there are questions and notes. Questions concerning whether the law should play a role in erasing the racial economic inequality it helped to create are highlighted throughout.
