Description

Designed as a bridge to practice, these simulation exercises help students understand how the rules of Criminal Procedure work in realistic settings. The third edition keeps issues of race and police practices front and center and allows students to engage in a discussion of the Court’s treatment of those issues. In addition, new simulations allow students to delve into difficult questions percolating among lower courts, including the Fourth Amendment implications of new technologies like drones, the use of social media by the police, and complex probable cause issues that arise in states where individuals may legally grow hemp, but are illegally growing marijuana.

Legal educators now recognize the need for their students to hit the ground running when they graduate. This book is designed to help students do just that. It consists of ten simulations, covering a wide array of issues arising under the Fourth Amendment, the Fifth Amendment, and Sixth Amendment taught in the basic Criminal Procedure course and gives students the opportunity to learn essential lawyering skills. For example, it puts students in the role of counselor, trial and oral advocate, and legal writer. One chapter includes role summaries and requires students to present testimony before the trial court hearing the defendant’s motion to suppress evidence. Others consist of transcripts of hearings and require students to present arguments to the court.
