We are about to publish the 13th edition of one of the best-selling casebooks of all time: Kamisar, LaFave, Israel, King, Kerr & Primus's Modern Criminal Procedure (and "spinoffs" Basic and Advanced). These materials afford a teacher maximum freedom to shape his or her own course in light of a particular teacher’s own sense of priorities and interests. At many places the editors have sought to enrich the case material with editors’ Notes & Questions or extracts from illuminating and insightful books, reports and law review articles.       The new edition is up-dated to include more recent Supreme Court and lower court opinions, and the coverage of various topics has been altered. The changes listed below are illustrative.



      In Chapter 2: reduced material on the "total incorporation" and "selective incorporation" theories. deleted material on the retroactive effect of a holding of unconstitutionality. added a major case on individual rights and the war on terrorism: Boumediene v. Bush (2008).

      In Chapter 3: added an extract from Brandon Garrett, Convicting the Innocent (2011).

      Chapter 9: a much more detailed summary of, and discussion of, various cases and developments since Miranda was decided. One reason for this is that there will be a summary and discussion of four new major confession cases: J.D.B. v. North Carolina, 131 S.Ct. 2394 (2011); Berghuis v. Thompkins, 130 S.Ct. 2250 (2010); Maryland v. Shatzer, 130 S.Ct. 1213 (2010) and Montejo v. Louisiana, 129 S.Ct. (2009). These four cases are set forth later in the chapter (along with many other cases).

      The new edition also has new extracts from a 2010 article by Prof. Barry Friedman, The Wages of Stealth Overruling, and another one by Charles Weisselberg, Mourning Miranda (2008).
